All business opportunity contracts must be in writing, and the Act sets forth various other requirements for business opportunity sellers. The sale of a franchise is exempt from these requirements if the franchise meets the FTC Rules definition of a franchise and the franchisor pays a fee and files a notice with the Florida Department of Agriculture and Consumer Services indicating its compliance with the requirements of the FTC Rule.
