Federal laws state that a franchise constitutes three elements: The use of a common name or trademark; the payment of a fee; and the rendering of ‘substantial’ assistance.The federal laws have a tendency to call anything which displays these three characteristics a franchise, irrespective of what the company offering it calls it. Regarding fees, this may be as little as a $500 one off fee, or indirect payments, such as profits made. Training, marketing and purchasing, amongst other things, all constitute ‘substantial assistance’. Franchising for some people constitutes too much of a risk and they prefer to offer their services as WSI consultants, helping others with their business plans.
